Terms and Conditions for Video Consultation Service
康健的視像診症服務(「視像診症服務」)使我們的香港註冊的醫生能夠通過實時交換視聽資訊的視像診症進行醫療諮詢,因此,使用者可以無需親臨醫務中心。
The video consultation service of Town Health ("Video Consultation Service") enables medical consultations to be conducted by Hong Kong registered medical practitioners by way of video consultation where audio and visual information are exchanged in real time. Thus, users may obtain health advice and services without physically attending to a medical practitioner.
本使用條款及細則(「本條款及細則」)內所用的「我們」、「我們的」及「康健」等字眼均指康健醫療及牙科服務有限公司及其母公司、子公司、附屬公司及關聯公司。本條款及細則內所用的「閣下」或「您」指任何本視像診症服務的用戶。
The terms "we", "us", "our" and "Town Health" when used in these terms and conditions ("Terms & Conditions") mean Town Health Medical & Dental Services Limited and its holding companies, subsidiaries, affiliates and related companies. The terms "you" and "your" when used in these Terms & Conditions mean any user of the Video Consultation Service.
通過註冊和使用視像診症服務,閣下同意受康健所有現行條款及細則的約束,包括但不限於本條款及細則的、隱私政策以及適用的個人資料收集聲明(康健的所有適用現行條款及細則統稱為「康健條款及細則」)。如康健條款及細則中的任何特定條款或細則與本條款及細則之間存在衝突,則以本條款及細則中的相關條款及細則為準。存取和使用視像診症服務以及與之相關的信息、材料、產品和服務均需遵守所有適用的法律法規以及康健條款及細則。
By registering and using the Video Consultation Service, you agree to be bound by all the prevailing terms and conditions of Town Health, including but not limited to these Terms & Conditions, the Privacy Policy and the applicable Personal Information Collection Statement(s) (all the applicable prevailing terms and conditions of Town Health are collectively referred to as "Town Health T&C"). In case of a conflict of any particular term or condition between any of the Town Health T&C and these Terms & Conditions, the relevant term and condition in these Terms & Conditions shall prevail. Access to and use of the Video Consultation Service and the information, materials, products and services related to it are subject to all applicable laws and regulations and to the Town Health T&C.
1. 視像診症服務
1. Video Consultation Service
1.1 閣下同意就使用視像診症服務自行承擔風險。視像診症服務並非旨在取代醫生與患者之間的面對面醫療諮詢。醫生提供的任何資料、建議、意見、診斷、治療、服務、醫療證明及/或藥物,均僅基於其專業判斷而提供。
1.1 You agree to use the Video Consultation Service solely at your own risk. The Video Consultation Service is not in any way designed or intended to replace regular in-person services between a medical practitioner and a patient. Any information, advice, opinion, diagnosis, treatment, service, medical certificate and/or medication provided by a medical practitioner are provided by the medical practitioner based solely on his/her exercise of professional judgement.
1.2 視像診症服務僅用於促進用戶與醫生之間的連接。康健 (i) 不推薦或認可任何特定的醫生;並且 (ii) 在適用法律允許的最大範圍內,對於醫生通過視像診症服務提供的任何資料、建議、意見、診斷、治療、服務、醫療證明及/或藥物,康健均不承擔任何法律責任,也推薦或認可該等內容,無論出於何種原因。
1.2 The Video Consultation Service is provided solely to facilitate the connection of user with medical practitioners. Town Health (i) do not recommend or endorse any particular medical practitioner; and (ii) to the maximum extent permitted by applicable law, are not responsible or liable, and do not endorse or support or recommend any information, advice, opinion, diagnosis, treatment, service, medical certificate and/or medication prescribed or given by those medical practitioners via Video Consultation Service, for any reason whatsoever.
2. 資格
2. Eligibility
2.1 視像診症服務僅供6歲及以上人士使用。如 閣下使用視像診症服務時未滿18歲,則必須在視像診症服務期間由成年人陪同。
2.1 The Video Consultation Service is only for use by persons age 6 and above. If you are under the age of 18 at the time of using the Video Consultation Service, you are required to be physically accompanied by an adult during the Video Consultation Service appointment.
2.2 視像診症服務僅適用於身處香港的人士。如 閣下身處香港以外,則不應使用此服務。
2.2 The Video Consultation Service is for persons physically located in Hong Kong only. You should not use this service if you are located outside of Hong Kong.
2.3 視像診症服務不適用於醫療緊急情況、緊急症狀或需要立即就醫的症狀。如 閣下有以下症狀或正在/曾經出現需要緊急服務或立即就醫的症狀,包括但不限於窒息、言語困難、自殺念頭或殺人的想法、呼吸困難、胸痛、嚴重出血、癲癇發作、失去知覺、頭部或脊柱受傷、手臂或腿無力、骨折、突發劇烈疼痛及/或其他嚴重的醫療或類似症狀,請不要使用視像診症服務。根據 閣下的情況,閣下應尋求緊急醫療協助或親自向醫生諮詢。
2.3 The use of Video Consultation Service is not suitable for medical emergencies, urgent medical situations or symptoms requiring immediate medical assistance. If you are/have been experiencing symptoms which require emergency services or immediate medical attention, which may include, without limitation: choking, speech difficulty, suicidal or homicidal thought, breathing difficulty, chest pain, severe bleeding, seizures, loss of consciousness, head or spinal injury, weakness in arm or leg, broken bones, severe pain and/or other serious medical or similar symptoms, please do not use the Video Consultation Service. Depending on your conditions, you should seek urgent medical assistance or seek advice from a medical practitioner in person.
3. 預約、變更或取消預約
3. Booking, Change or Cancellation of Appointments
3.1 閣下需自行負責選擇預約的醫生,並考慮該醫生是否適合治療閣下的任何症狀。
3.1 You are solely responsible for selecting the medical practitioner and considering the suitability of such medical practitioner in relation to any symptoms you may be experiencing.
3.2 閣下預約視像診症服務時需提前支付諮詢費。預約將在 閣下支付諮詢費並且由我們的工作人員與 閣下聯繫之後才會被確認。
3.2 To book an appointment for the Video Consultation Service, you are required to pay the consultation fee in advance. The booking will not be confirmed until the consultation fee payment is made and you are contacted by our staff.
3.3 如 閣下因任何原因沒有在預定視像診症服務預約開始時間後的15分鐘內出席,閣下的預約將被取消,閣下支付的諮詢費將被沒收。
3.3 If you do not show up within 15 minutes after the scheduled start time of your Video Consultation Service appointment for any reason whatsoever, your appointment will be cancelled and the consultation fee paid by you will be forfeited.
3.4 一旦付款並由我們的工作人員確認預訂後,視像診症服務預約將無法改期、取消、轉讓或退款。
3.4 Once the payment is made and the booking is confirmed by our staff, the Video Consultation Service appointment cannot be rescheduled, cancelled, transferred or refunded.
4. 服務
4. Services
4.1 進行視像診症服務的醫生如果根據其專業判斷認為有必要和合適,可向 閣下處方藥物及或簽發醫療證明。我們不以任何方式保證醫生會在進行醫療諮詢後向 閣下處方任何藥物及/或簽發醫療證明。
4.1 The medical practitioner attending the Video Consultation Service appointment may prescribe medications and/or issue medical certificates to you if he/she considers such to be necessary and appropriate based on his/her professional judgement. We do not in any way guarantee that a medical practitioner will prescribe any medication and/or issue any medical certificate to you after a medical consultation.
4.2 諮詢費僅涵蓋通過視像診症服務進行的醫療諮詢,三天的基本藥物及在香港島、九龍和新界的配送。任何額外藥物或特別藥物以及送往離島及偏遠地區的配送費用將另外收取。如果醫生根據其專業判斷認為有必要和合適處方任何額外藥物或特別藥物,閣下將需要支付額外的藥物費用。任何已處方及支付費用的藥物均不可退還、更換或退款。
4.2 The consultation fee only covers the medical consultation through the Video Consultation Service with three days basic medication and delivery within the Hong Kong Island, Kowloon and New Territories. Any extra medication or special medication and the delivery fee to the Outlying Islands and remote areas will be separately charged. If the medical practitioner renders it necessary and appropriate to prescribe any extra medication or special medication based on his/her professional judgement, you will be liable to pay the additional medication fees. Any medication prescribed and paid for is not returnable, exchangeable or refundable.
5. 價格及付款
5. Price and Payment
5.1 閣下同意並承諾根據到期應付時生效的費用、收費和計費條款,支付所有與視像診症服務相關的費用或收費。
5.1 You agree and undertake to pay all fees or charges to us for the use of the Video Consultation Service in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.
5.2 閣下授權康健即時從 閣下提供的信用卡或其他付款賬戶中扣除所有到期應付的費用和收費,並同意無需額外通知或同意。
5.2 You authorise Town Health to immediately debit your credit card or other payment account provided for all fees and charges due and payable and agree that no additional notice or consent is required.
6. 我們的權利
6. Our Rights
6.1 我們保留隨時修改、暫停或永久終止視像診症服務或其任何部分的權利,無論是否發出通知。閣下同意我們對於視像診症服務或任何服務或其任何部分的修改、暫停或終止不對 閣下或任何第三方承擔責任。
6.1 We reserve the right at any time to modify, suspend or discontinue, temporarily or permanently, the Video Consultation Service or any part thereof with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Video Consultation Service or any service or any part thereof.
7. 閣下的責任
7. Your Obligations
7.1 請注意某些醫療狀況並不適合使用視像診症服務。如 閣下不確定是否能通過視像診症服務清楚地說明 閣下的醫療問題,閣下 應始終親親臨醫務中心向醫生尋求建議。
7.1 Please note that certain medical conditions are not suitable for using the Video Consultation Service. If you are uncertain as to whether you have been able to explain your medical concerns through the Video Consultation Service, you should always seek advice from a medical practitioner in person.
7.2 閣下同意並應確保:閣下透過視像診症服務向我們或醫生提供的所有資料均真實準確;閣下遵循醫生給 閣下的任何指示;閣下按照醫生對處方或建議的藥物及保健產品的任何使用指引;閣下妥善保管提供給 閣下的任何藥物,並且不允許任何其他人士(尤其是兒童)使用;閣下向醫生告知病歷、任何藥物過敏情況、治療建議引起的任何異常或不良反應及其他相關資料;如閣下的任何資訊需要更新,請 閣下通知向我們告;及閣下僅為自己本人使用視像診症服務。
7.2 You agree that you shall ensure: any information you provide to us or to medical practitioners through the Video Consultation Service is true and accurate; you follow any instructions you are given by the medical practitioners; you follow any instructions about the use of any medications and healthcare products prescribed or suggested by the medical practitioners; you keep any medications provided to you secured and do not permit any other persons (especially children) to use them; you inform the medical practitioner about your medical history, any drug allergy, any unexpected or adverse effects of treatments suggested and any other relevant information; you inform us if any information about you needs to be updated; and you use the Video Consultation Service only for yourself.
8. 第三方供應商
8. Third Party Providers
8.1 閣下知悉視像診症服務的部分內容由第三方供應商提供及/或維護。
8.1 You acknowledge that part of the Video Consultation Service is contributed, provided and/or maintained by third party providers.
8.2 在法律允許的最大範圍內,閣下承認並同意康健對任何第三方供應商提供或呈現的服務不作任何明示或暗示的聲明、陳述或保證;不同意、反對、推薦或認可任何第三方供應商提供的建議、材料或服務;對任何第三方供應商提供的建議、材料和/或服務不承擔任何責任;對每個第三方供應商所負責的服務的表現不作任何保證;對於因使用、無法使用或誤用或依賴第三方供應商的建議、材料或服務而引起的任何直接或間接的損失、費用或損害不承擔任何義務或責任;以及對於因第三方供應商向用戶提供的服務而引起的任何損失、損害、財產損壞、人身傷害或死亡不承擔任何義務或責任。
8.2 To the fullest extent permitted by law, you acknowledge and agree that Town Health makes no statement, representation or warranty, express or implied, in relation to any services provided or rendered by any third party providers; does not agree, disagree, approve or endorse any advices, materials or services provided by any third party providers; shall not be responsible in any way for any advices, materials and/or services provided by any third party providers; makes no guarantee whatsoever as to the performance of the services for which each third party provider is responsible; shall not have or accept any liability, obligation or responsibility whatsoever for any direct or indirect loss, costs or damage howsoever arising from or in respect of any use, inability to use or misuse of or reliance on advices, materials or services provided by any third party providers; and shall not have or accept any liability, obligation or responsibility whatsoever for any loss, damage, destruction of property, personal injury or death of the user arising out of or relating to services provided by a third party provider to the user.
9. 個人資料
9. Personal Data
在註冊並使用視像診症服務,閣下可能會被要求向我們提供某些個人資料(根據香港法例第486章《個人資料(私隱)條例》的定義)。閣下提供的任何個人資料將根據私隱政策使用。
In registering and using the Video Consultation Service, you may be requested to provide us with certain personal data (as defined in the Personal Data (Privacy) Ordinance, Chapter 486 of the Laws of Hong Kong). Any personal data you supply to us will be used in accordance with the Privacy Policy.
10. 賠償
10. Indemnities
10.1 閣下同意賠償康健、其服務提供者、承包商、分包商、授權人及代理人(包括但不限於第三方供應商)及其各自的高級職員、董事和員工(統稱為「受賠償方」),以彌補因以下原因所引起或相關的任何行動、責任、費用、索賠、損失、損害、訴訟及/或開支:閣下註冊及/或使用視像診症服務及其下的任何服務;及閣下及/或其他使用閣下預約的視像診症服務的人士對康健條款及細則的任何違反或不遵守。
10.1 You agree to indemnify Town Health, its service providers, contractors, sub-contractors, licensors and agents (including but not limited to the third party providers) and their respective officers, directors and employees (collectively, the "Indemnified Parties") against any action, liability, cost, claim, loss, damage, proceeding, and/or expense suffered or incurred by any of the Indemnified Parties arising from or which is related to: your registration with and/or your use of the Video Consultation Service and any services thereunder; and any breach or non-observance of any Town Health T&C by you, and/or other person(s) using the Video Consultation Service on your account.
11. 免責聲明及責任限制
11. Disclaimers and Limitation of Liability
11.1 我們會盡力確保視像診症服務的資料、功能或其他內容於截至發佈日期屬當時現行資料,並且真確無誤,但我們不對任何資料(明示或暗示)作出任何形式的保證或聲明,尤其是其準確性、充分性、完整性、準時性、無侵權、可靠性、惡意軟件免疫力、安全性、可商售性或對特定用途的適用性,或通過視像診症服務提供的任何本資料、功能、內容或任何服務是否適當或可供使用而作出任何明示或默示的保證或聲明。閣下同意使用視像診症服務時,須完全自行承擔一切風險,且 閣下有責任評估任何連結網站所載的一切資料、陳述、意見及其他材料的準確性及完整性。
11.1 Whilst we have endeavoured to provide you with the information, features or other content in the Video Consultation Service current as at the date of publication and accurate, they are provided without warranty or representation of any kind, whether express or implied. In particular, no warranty or representation, express or implied, is given regarding accuracy, adequacy, completeness, timeliness, non-infringement, reliability, freedom from malware, security, merchantability or fitness for a particular purpose, for any information, materials or service through the Video Consultation Service, or whether such information, material or service are appropriate or available for use. You agree that your use of the Video Consultation Service is entirely at your own risk and it is your responsibility to evaluate the accuracy and completeness of all information, statements, opinions and other material in any linked sites.
11.2 於適用法例允許的最大範圍內,對於因 閣下使用或未能使用視像診症服務而引致的任何直接的、間接的、附帶的、特殊的、懲罰性的或相應引致的損害賠償,包括但不限於失去利潤、商譽、數據或其他無形損失的損害賠償,即使我們已獲悉有可能出現該等損害賠償,康健毋須亦不會承擔任何責任。
11.2 To the fullest extent permitted by applicable law, Town Health excludes all liability for any direct, indirect, incidental, special, punitive or consequential damages, including but not limited to damages for loss of profits, goodwill, data or other intangible losses resulting from or arising out of your use, or the inability to use the Video Consultation Service or any part thereof, even if we have been advised of the possibility of such damages.
12. 技術要求
12. Technical Requirements
12.1 視像診症服務及其項下的服務可透過互聯網、數據網絡及可連接互聯網的設備(「基礎設施」)使用。康健對基礎設施本身不承擔任何責任。使用視像診症服務時,閣下應檢視是否擁有可連接互聯網的設備及互聯網連接是否充分和穩定。
12.1 The Video Consultation Service and the services thereunder are accessed using the internet, data networks and devices which can access the internet ("Telemedicine Infrastructure"). Town Health is not responsible or liable for the Telemedicine Infrastructure themselves. You should ensure that your device can access the internet and there is adequate and stable internet connection to use the Video Consultation Service and the services thereunder.
12.2 如 閣下以無線網絡使用視像診症服務,請避免使用公共Wi-Fi設施,且應使用安全性保護無線網絡。
12.2 If you are using a wireless network to use the Video Consultation Service, it is recommended that you should use a secure wireless network and avoid using public Wi-Fi facilities.
13. 一般規定
13. General Provisions
13.1 倘若本條款及細則的任何條款被任何有效司法管轄區的法院裁定為違法、失效或基於任何理由不能執行,則該條款應被視為本條款及細則的可分割部份,且不會影響任何其餘條款的有效性及執行性。
13.1 If any provision of these Terms & Conditions is held by a court of competent jurisdiction to be unlawful, void or for any reason unenforceable, such provision shall be deemed severable from these Terms & Conditions and shall not affect the validity and enforceability of any remaining provisions.
13.2 我們在任何時候未要求履行本條款及細則的任何條款或未行使當中所提供的任何權利,均不應被視為我們對該條款或權利的豁免。一切豁免必須由我們以書面作出。除非書面豁免包含明確的相反聲明,否則我們對本條款及細則中任何條款違反或任何權利的豁免,均不應被解釋為對該條款的持續或隨後違反作出豁免、或就有關條款本身作出豁免,或對本條款及細則下的任何權利的豁免。
13.2 Our failure at any time to require performance of any provision of these Terms & Conditions or to exercise any right provided for herein shall not be deemed a waiver of such provision of such right. All waivers by us must be in writing. Unless the written waiver contains an express statement to the contrary, no waiver by us of any breach of any provision of these Terms & Conditions or of any right provided for herein shall be construed as a waiver of any continuing or succeeding breach of such provision, a waiver of the provision itself, or a waiver of any right under these Terms & Conditions.
13.3 視像診症服務僅供香港管轄範圍內使用。某些國家司法管轄區的法律可能禁止存取或使用視像診症服務或其下的任何資訊、資料、產品及/或服務。我們不保證此處包含的資訊適合或可在其他地方使用。
13.3 The Video Consultation Service is provided for use within the jurisdiction of Hong Kong. Access to, or use of, the Video Consultation Service or any information, materials, products and/or services thereunder may be prohibited by law in certain countries or jurisdictions. We make no representation that the information contained herein is appropriate or available for use in other locations.
13.4 本條款及細則以及與 閣下存取和使用視像診症服務及其下的服務相關的所有事項將受香港法律的管轄並按其解釋,閣下同意接受香港法院的專屬管轄權。
13.4 These Terms & Conditions and all matters relating to your access to and use of the Video Consultation Service and the services thereunder shall be governed by and construed in accordance with the laws of Hong Kong and you agree to submit to the exclusive jurisdiction of the Hong Kong courts.
13.5 如本條款及細則的英文版本與中文版本之間存在歧義或差異,則以英文版本為準。
13.5 In the event of any inconsistency or discrepancy between the English and the Chinese versions of these Terms & Conditions, the English version shall prevail.
